Consultation has concluded

In December of 2021, the City Commission adopted their priorities via Resolution 5368 for the following two years. One of the identified priorities was as follows:

"Model HOA Covenants - Establish model home owners association covenants that encourage water conservation, neighborhood and community connectivity, accessory dwelling units, child care, drought tolerant landscaping, composting, local food, recycling and energy efficiency."

Staff got to work! On November 15, 2022 the City Commission held a work session on model POA / HOA covenants. Staff from multiple departments submitted recommendations based on their expertise. Recommendations were provided and organized via problem and solution statements

Please help us make our model covenants the best they can be by reviewing the presentation and completing the short survey on this page!

The outcome of this effort will be draft language that can be easily accessed and included in new or existing covenants. The language will be informed by public input, guided by community goals, and supported by the City Commission.

Covenants are formal agreements between private parties, and as such, the City does not enforce covenants between private parties, nor will the City mandate HOAs and POAs adopt the model language.

    On November 21, Commission approved the model covenants with amendments. We have finished incorporating their edits and have now uploaded the documents for all to use as you create and update your HOA laws! See below:

    Thank you all so much for your feedback and help in this project. This was a first and much-needed step in improving covenants across the city.

    Residents provided input on the proposed model covenants at a focus group, and community wide survey, as well as through the November Sustainability Advisory Board meeting and InterNeighborhood Council Meeting. City Commission will consider the model covenants for adoption by resolution at their meeting on Tuesday, Nov. 21st at their regular meeting. Find information to join at www.bozeman.net/meetings.

    Join us on October 26th at the Bozeman Public Safety Center from 5:30pm to 6:30pm to share your thoughts on the topics we're tackling! The City's goal with this project is to provide sample language that new or existing homeowners and property owners associations can integrate into their covenants to align them with city priorities like water conservation, ADUs, and childcare. Take the survey to learn more, share your thoughts, and join us on the 26th!
